Terms & Conditions These terms and conditions govern your use of the web site and any contract between you and Polysert UK Ltd for the purchase of goods. By ordering goods from the Ultrashield.info web site you agree to be bound by these terms and conditions and agree that they constitute a legally binding contract between you and Polysert UK Ltd. 1 Definitions Ultrashield.info, means the company Polysert UK Ltd. Office address, Unit F3, Fort Wallington Industrial Estate, Military Road, Fareham, Hampshire, PO16 8TT. "you" means any user of the web site "goods" means any products (including but not limited to Solar Inserts, Window Film, Polycarbonate) available on the web site "Agreement" means these terms & conditions "working day" means Monday through Friday inclusive, except for public & bank holidays "web site" means the web site accessible at the url http://www.ultrashield.info "P&P" means postage and packing 2 Communication Via Email 2.1 You agree that all communications between Polysert UK Ltd and you can be made by email or telephone. 2.2 Unless otherwise expressly stated, any notices sent by email pursuant to the terms of this Agreement shall be deemed to have been made upon such email being sent. 2.3 Without prejudice to your rights and Polysert UK Ltd. Obligations under relevant data protection laws, any personal information you send to polysert.co.uk via email is done so at your own risk. 3 Use of web site 3.1 Your use of the web site is subject to our conditions of use and disclaimer (To view click on link). 3.2 Polysert UK Ltd reserves the right to withdraw the web site, any information contained in the web site, and any goods offered for sale on the web site, at any time in part or in whole without any prior notice. 3.3 You agree not to use the web site in any way which may cause degradation in performance of the web site or Polysert UK Ltd computer systems or interruption to the web site’s or Polysert UK Ltd systems operation. 3.4 Polysert UK Ltd reserves the right to investigate your use of the web site for any reason whatsoever and report any suspected unlawful use of the site or fraudulent use of any credit or debit card or other payment method to relevant law enforcement authorities. 3.5 You are responsible for ensuring that use of this web site or any part of it is permissible in your jurisdiction. You agree that Polysert UK Ltd shall not be liable to you to the extent that any laws in your jurisdiction render Polysert UK Ltd performance of its obligations under this Agreement unlawful. 3.6 You agree to fully indemnify Polysert UK Ltd for any claims, damages and costs, including legal fees, suffered by Polysert UK Ltd arising out of any misuse of the web site by you or any user of your computer equipment, whether authorised by you or not, or any misuse of the web site or your Polysert UK Ltd account information by any other user (except to the extent that such misuse arises from unlawful disclosure of your account information by Polysert UK Ltd to third parties). 3.7 You must be 18 years or older to use the web site and purchase goods offered for sale on the web site. 4 Offer To Purchase 4.1 An order placed by you through this web site will be considered as an offer to purchase goods from Polysert UK Ltd. Until your offer has been accepted in accordance with the terms of this Agreement, no contract for the sale of goods exists between you and Polysert UK Ltd and for the avoidance of doubt, prior to such acceptance, Polysert UK Ltd shall have no obligation to deliver any goods pursuant to your order. 4.2 On receipt of your order Polysert UK Ltd shall issue a confirmation email ("Confirmation Notice") to confirm receipt of your order. 4.3 Polysert UK Ltd reserves the right to refuse to accept an offer to purchase goods for any reason whatsoever. 5 Cancellation Of An Order 5.1 You may cancel an order, or part order, at any time after you have placed it and before a contract for the sale of goods is in effect between yourself and Polysert UK Ltd in accordance with the terms of this Agreement. 5.2 You must communicate this cancellation by email (sent from yourself to us) to sales@polysert.co.uk, by telephone to +44 (0)1329 289544 or in writing (by letter sent to Polysert UK Ltd place of business) and you must specify the order number(s) to which the cancellation relates, full details or all items to be cancelled and your name and address. 5.3 Polysert UK Ltd shall endeavour to review and act upon your cancellation request as soon as practicable, however it may take up to 28 days from the time Polysert UK Ltd receives your request until the time Polysert UK Ltd reads and acts upon your request. If Polysert UK Ltd does not process your cancellation request until after acceptance of your offer, Polysert UK Ltd will act upon your request and will confirm cancellation of the contract as soon as practicable thereafter. 6 Contract and title 6.1 A contract between you and Polysert UK Ltd for the purchase of goods will come into effect when all of the following conditions have been satisfied: 6.1.1 you place an order through the web site or through the web site of one of Polysert UK Ltd affiliates 6.1.2 your order is not rejected by Polysert UK Ltd 6.1.3 an acceptance email ("Acceptance Notice") is sent to you to confirm acceptance of your offer to purchase goods and to confirm receipt of payment for the goods. For the purpose of this clause, your offer will be deemed to be accepted at the point when Polysert UK Ltd sends the Acceptance Notice. 6.2 The Acceptance Notice will be sent to you at the email address specified by you on your customer account at the relevant time. It is your responsibility to review the Acceptance Notice and advise Polysert UK Ltd of any changes to any information provided by you. You should keep a hard copy of the Acceptance Notice. A copy can be provided to you should you lose the original. The copy will be sent to you via email only. 6.3 Polysert UK Ltd shall arrange delivery of the goods to the address specified by you in your order, unless you specify in your order that you will arrange for your own collection from Polysert UK Ltd place of business. 6.4 You pay in advance and in full for the goods prior to them being dispatched to you. Polysert UK Ltd will not charge your payment card until the goods are on Polysert UK Ltd premises and allocated to your order. 6.5 Title of goods will pass to you at the point that Polysert UK Ltd charges your payment card or, when other payment methods are used, funds are credited to Polysert UK Ltd account. 7 Withdrawal from contract 7.1 you may not withdraw from a contract to purchase goods if you are buying the goods for business purposes or if they are intended for use or used for anything other than private or personal use. 7.2 You may withdraw from your contract for the purchase of goods from Polysert UK Ltd from the time it is made up to and including 7 working days from the day after you have received your goods (at its discretion Polysert UK Ltd may extend the number of working days). 7.3 Polysert UK Ltd will refund the full amount you paid for the goods within 30 days of your cancellation notice provided that you comply with your obligations in Clause 7.3 and 7.4 below. Polysert UK Ltd will not provide a refund if any packaging or seals on the goods have been broken. 7.4 To withdraw from a contract for the purchase of goods you must communicate this to Polysert UK Ltd by email (sent from yourself to) to sales@polysert.co.uk, by telephone to (+44 (0)1329 289544 or in writing (by letter sent to Polysert UK Ltd place of business) and you must specify the order number(s) to which the cancellation relates and full details of all items in respect of which you wish to cancel. 7.5 Once Polysert UK Ltd has read and accepted your request to withdraw from the contract Polysert UK Ltd will issue you with a returns authorisation and other instructions necessary for you to return the goods to Polysert UK Ltd (in the event that the goods have already been dispatched or delivered to you). You agree to comply with all such instructions and to take reasonable care to ensure that the goods are received by Polysert UK Ltd in undamaged condition. Polysert UK Ltd will not refund you if you do not take reasonable care to ensure that goods arrive undamaged and this results in non-delivery or damage to returned goods. 7.6 You will be responsible for bearing the cost of returning any goods to us where you cancel the contract in accordance with this clause 7 of the Agreement. 8 Price and Payment 8.1 Polysert UK Ltd reserves the right to change prices listed on the web site without prior notice. 8.2 The price you pay for goods is as shown on our web site at the time you order the goods and includes VAT where applicable. 8.3 A separate P&P charge may apply to goods and this will be shown on the web site. The P&P charge shown is for the UK only. If you purchase goods for delivery to a country other than the UK the P&P charge will be confirmed when you set up your account or access it to place your order. 8.4 Polysert UK Ltd accepts payment by credit and debit card. 9 Delivery of goods 9.1 Delivery of goods ordered by you will be made within 30 days after Polysert UK Ltd acceptance of your offer by way of the Acceptance Notice. Polysert UK Ltd may at its discretion deliver the goods in separate consignments. 9.3 If you do not receive the goods within 30 days of the Acceptance Notice, you must notify Polysert UK Ltd by email (to sales@polysert.co.uk) within [30] days of the due delivery date. This notification must conform to the requirements specified by Royal Mail (a copy of which will be emailed to you after you notify Polysert UK Ltd of any goods not received). 9.4 If you do not receive the goods within the time limits set out above, and you notify us as required, we will refund the amount you paid for the goods or credit your Polysert UK Ltd account, unless we agree with you to resend the goods. 9.5 Polysert UK Ltd shall not be liable for any duties, customs or other taxes that may be imposed by an authority in any country outside the EU. 10 Faulty/incorrect goods and returns 10.1 Polysert UK Ltd will replace any goods returned by you which when delivered were either damaged or did not conform to the specification stated on the web site, provided you notify Polysert UK Ltd in writing within 14 days of delivery of the goods to the address specified on your order. [You must send any goods back by recorded delivery if over £35, if under £35 please obtain a free certificate of posting from the post office. We cannot be held responsible for items missing in the post without proof of posting] 10.2 Goods will only be replaced after the original goods are returned. Polysert UK Ltd will not be liable for any goods that are not returned by you as required. Polysert UK Ltd will refund the amount paid by you for the goods or, if agreed with you, credit your Polysert UK Ltd account. Polysert UK Ltd will refund the reasonable costs associated with returning faulty or incorrect goods to Polysert UK Ltd. 10.3 Remaining unbroken/unused rolls after installation can be returned back to the place of business of Polysert UK Ltd for a pro-rata refund. Goods lost or damaged in transit to Polysert UK Ltd will be the responsibility of the customer. Polysert UK Ltd will not be liable for any losses or damage caused during transit. All returns must be accompanied by a valid Polysert UK Ltd returns note and must be returned no later than 30 days after the goods have been received. Goods returned without an accompanying returns note, or are part used, or are returned after 30 days from when the order was received, will not be subject to a refund and Polysert UK Ltd will not be liable for the costs of returning the goods to the customer. 11 Liability 11.1 Polysert UK Ltd confirms that in relation to any goods purchased from the web site: (a) Polysert UK Ltd has the right to sell the goods to you; (b) the goods will correspond with the description given on the web site; and (c) the goods will be of satisfactory quality. 11.2 Polysert UK Ltd excludes all other express or implied terms, conditions, warranties, representations or endorsements with regards to any goods. Polysert UK Ltd accepts no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect) however caused or whether foreseeable or not, arising from your purchase of goods on the web site. 11.3 Polysert UK Ltd total liability to you under any contract for the purchase of goods or otherwise under this Agreement will be limited to the amount paid by you for any goods purchased. 1.4 Polysert UK Ltd will not be responsible for any loss or damages incurred by unauthorised use of your payment card on the web site. Polysert UK Ltd is not responsible for notifying your card issuer or any law enforcement authority in these instances. 11.5 The limitations and exclusions in this clause do not affect your statutory rights and only apply to the extent permitted by applicable law. Nothing in this Agreement shall serve to limit Polysert UK Ltd liability for personal injury or death caused by negligence. 12 Force Majeure 12.1 Polysert UK Ltd shall not be liable for any failure to deliver or delay in delivery of the goods, or damage to goods delivered, arising from circumstances beyond Polysert UK Ltd reasonable control. 13 Entire Agreement 13.1 The above represents the entire terms and conditions relating to your use of the web site to order goods and the supply of goods to you. The terms and conditions can not be varied except as specified above. 13.2 These terms and conditions can only be varied in writing when signed by a director of Polysert UK Ltd. No additional terms or conditions requested by and communicated in any way by you will form part of the contract whether accepted or not by an employee of Polysert UK Ltd. No employee of Polysert UK Ltd can alter the terms and conditions of this contract whether or not they confirm this to you in any way. 14 Governing Law This Agreement and any contract for the purchase of goods shall be construed in accordance with and governed by the laws of England 15 Improvements 15. The company's policy is to continue to develop and improve its products, and therefore reserves the right to vary the design or specification of any of its products without prior notice to the customer. |
